A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE YOUR CHANCES OF WINNING

By participating, you agree to these Official Rules and the decisions of Quick Lane® Tire and Auto Center (“Sponsor”) and Group E Marketing Services LLC (“Administrator”), which are final and binding in all respects and not subject to appeal.

The Contest is offered only in the fifty (50) United States and the District of Columbia. Contest is void elsewhere and where prohibited.

The following persons are NOT eligible to participate either as an Entrant or Nominee (or as both an Entrant and a Nominee, if a Veteran) or win a prize in the Contest:

  • Employees, directors and officers of Sponsor, GTB Agency, LLC, Administrator; the parents, subsidiaries, divisions and affiliates of any of the foregoing entities (collectively, the “Contest Entities”);
  • The immediate family of any such employee/officer/director (“immediate family” being defined as spouse, siblings, parents, children and their spouses, regardless of where they live);
  • Members of the same household of any such employee/officer/director, whether related or not;
  • Individuals who won any prize in any previous “Trading One Uniform for Another” Contest sponsored by Quick Lane® Tire and Auto Center.

Contest Schedule:

The Contest will begin on 8/12/19 at or after 12:00 a.m. [midnight] Eastern Time (“ET”) and end on 12/6/19 at 11:59 p.m. ET. Administrator’s computer is the official time keeping device for the Contest.

Eligibility:

The Contest is open only to legal residents of the 50 United States and District of Columbia, who are twenty-one (21) years of age or older. Contest is void elsewhere and where prohibited.

  1. Entrant:

    An Entrant nominates ANOTHER PERSON (and NOT him/herself) for evaluation by judging panel(s) for possible receipt of a Grand Prize of a $10,000 scholarship to a college or university in the United States to study automotive mechanics, engineering or similar approved subject matter. An Entrant him/herself is NOT entered to win a Grand Prize scholarship in the Contest and will NOT receive any prize, award or compensation of any kind even if the other person the Entrant nominated in his/her Entry is determined to be a winner of a Grand Prize scholarship in the Contest.

  2. Nominee:

    A Nominee is ANOTHER PERSON who is nominated by an Entrant for evaluation by judging panel(s) for possible receipt of a Grand Prize of a $10,000 scholarship to a college or university in the United States. A Nominee must also:

    1. have served in any branch of the United States Armed Forces and received an honorable discharge from active military service (“Veteran”); or be a first responder (whether or not certified as such), including but not limited to paramedics, emergency medical technicians (“EMTS”), firefighters and police officers (“First Responder”);
      AND
    2. be currently enrolled (or plan to be enrolled by 8/31/2020*,) in a college or university (including both four [4] year and two [2] year colleges and universities) located in the 50 United States or Washington, DC which has been accredited by the U.S. Department of Education.
  3. {*Have applied to and been accepted by a college/university.}

  4. Veteran (self-nomination):

    Notwithstanding the foregoing, a Veteran MAY enter/nominate him/herself for evaluation by judging panel(s) for possible receipt of a Grand Prize of a $10,000 scholarship to a college or university in the United States to study automotive mechanics, engineering or similar approved subject matter: a Veteran nominating him/herself for a Grand Prize scholarship will therefore participate in the Contest as both an Entrant AND a Nominee. As used throughout these Official Rules, the terms Entrant and Nominee include a Veteran who nominates him/herself for a Grand Prize scholarship, as the case warrants (even when a Veteran nominating him/herself for a Grand Prize scholarship has not been expressly identified in the relevant provision of these Official Rules).

    (Self-nomination is NOT available to First Responders; and, First Responders can only be Nominees who were nominated by someone else who is an Entrant.)

How To Enter:

During Submission Period, visit the Contest Website at www.qltradingone.com (“Contest Website”). Then, complete the official entry form with all required information about you (as the “Entrant”) and your Nominee (“Entry”). Required information includes the name, address, daytime telephone number and email address of both you (as the Entrant) and the Nominee, as applicable. (If a Veteran is entering him/herself, when completing the official entry form, list “Self” as the Nominee.) In the indicated area of the entry form, input your nomination of the Nominee: an original statement of 50 – 100 words in English as to why you believe that your Nominee deserves to receive from Sponsor a $10,000 scholarship to pursue a college/university education in automotive mechanics, engineering or a similar area of study as approved by Sponsor (if a Veteran nominating him/herself, nomination will explain why you believe that you deserve to receive the $10,000 scholarship).

Consent of Nominee:

  • IT IS THE ENTRANT’S SOLE RESPONSIBILITY TO SECURE THE WRITTEN CONSENT OF THE NOMINEE VIA THE PRESCRIBED RELEASE FORM PRIOR TO SUBMISSION OF ENTRY. ENTRANT MUST OBTAIN PERMISSION FROM THE NOMINEE FOR THE ENTRANT TO NOMINATE SUCH PERSON, TO PROVIDE THE NOMINEE’S NAME AND CONTACT INFORMATION TO SPONSOR, TO INCLUDE THE NOMINEE’S NAME AND INFORMATION ABOUT THE NOMINEE IN THE SUBMISSION, AND TO GRANT TO SPONSOR THE RIGHT TO USE NOMINEE’S NAME AND LIKENESS AS DESCRIBED IN THE OFFICIAL RULES.†

† This does not apply to a Veteran nominating him/herself.

Restrictions on Entry:

  • A given person may only submit one (1) Entry. (For the avoidance of doubt, a Nominee may be nominated separately by more than one (1) Entrant.)
  • A Veteran may nominate him/herself and may be nominated by Entrant[s]. An Entry’s nomination may only be for one (1) Nominee.
  • Any violation or attempted violation of the foregoing entry limits may result in disqualification of Entrant and/or Nominee (and, in the case of a Veteran nominating him/herself, disqualification of such Veteran) in the sole discretion of Sponsor/Administrator.
  • Nominations will only be accepted if included as part of an Entry; if submitted otherwise, nomination is void.
  • If an Entrant nominated someone or a Veteran nominated him/herself in any previous “Trading One Uniform for Another” Contest sponsored by Quick Lane® Tire and Auto Center, the Entrant/Veteran may submit another Nomination in the Contest provided that the Entry contains a different statement than the statement included in any previous “Trading One Uniform for Another” Contest. (But, as stated above, an individual who won any prize in any previous “Trading One Uniform for Another” Contest CANNOT enter or win a prize in this Contest.)

Additional Restrictions:

Once submitted, a nomination cannot be modified or supplemented by Entrant or Nominee. Notwithstanding the foregoing, Sponsor and/or Administrator may request an Entrant and/or Nominee to substantiate the information included in a nomination. If Entrant and/or Nominee do not timely respond to such request or if, in the sole discretion of Sponsor and Administrator, materials provided by Entrant and/or Nominee in response to such request do not serve to adequately substantiate the information included in the nomination, the Entry will be declared void, with the Entrant and Nominee being declared ineligible for the Contest (including without limitation, if a Veteran nominated him/herself, such Veteran will be declared ineligible). Without limiting the foregoing, should Sponsor and/or Administrator determine that Entrant and/or Nominee sought to mislead or defraud Sponsor/Administrator in conjunction with Contest participation, Sponsor/Administrator reserve the right to pursue all available legal remedies against Entrant and/or Nominee, as applicable.

Privacy Policy:

Information collected from Entrants and about Nominees or from Nominees themselves (including but not limited to from Veterans who nominated themselves) is subject to Quick Lane’s Privacy Policy accessible at http://www.qltradingone.com/privacy.

Additional Restrictions on Content of Entry:

Submissions (i.e., nominations) must be truthful and Sponsor reserves the right to verify information contained in the Submission. Do NOT exaggerate or embellish the Nominee’s words or deeds in explaining why he/she deserves to receive a scholarship. Submissions must be the original work of the Entrant (if a Veteran nominated him/herself, the original work of that Veteran). In addition, Entrants agree that all entries shall meet the following requirements and guidelines (any entry that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified and will not be considered an Eligible Entry):

  1. Entries must constitute an original work of Entrant, and must be keeping with the Sponsor’s image, as determined by Sponsor in its sole discretion.
  2. Entries must not infringe upon the copyrights, trademarks, right of privacy, publicity or other intellectual property rights or other rights of any third party.
  3. Entries must not be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, illegal, discriminatory or harassing, or display inappropriate activity, behavior or conduct or contain nudity.
  4. Entries must not promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message.
  5. Entries must not be obscene or offensive, crude or vulgar, endorse any form of hate or hate group, gang signs or symbols.
  6. Entries must not contain trademarks owned by others or advertise or promote any brand or product of any kind, without permission.
  7. Entries must not contain any personal identification, such as license plate numbers, personal names**, email addresses, websites, webpage links or street addresses.
  8. Entries must not contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission.
  9. Entries must not contain materials embodying the names**, likenesses, voices or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission.
  10. Entries must not include look-alikes or celebrities or public or private figures, living or dead.
  11. Entries must not communicate messages or images inconsistent with the positive images and/or goodwill to which the Released Parties wish to associate.
  12. Entries must not depict and/or contain any content that is in violation of these Official Rules and/or any applicable laws.

**As used herein, “names” refers to persons other than the Nominee (provided that a Veteran has not nominated him/herself).

Additionally, if any entry contains any material or elements that are not owned by the Entrant and/or which are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any Entrant at any time. Failure to provide such proof may, if requested, render the Entry null and void. By submitting an Entry, Entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein. Sponsor shall have the right to modify a statement to bring the Submission in compliance with these requirements should it feel it is necessary in its sole discretion. All Submissions will be reviewed for content eligibility and compliance with these Official Rules before being judged. Submissions containing false information, prohibited material or inappropriate content, as determined by the Sponsor, in its sole discretion, may be disqualified. Sponsor makes the final determination as to what Submissions are eligible to take part in this Contest. Entering a Submission grants Sponsor and its agents the unconditional, irrevocable, worldwide right to publish, use, adapt, edit and/or modify such Submission in any way, in any and all media, without limitation, and without consideration to the Entrant whether or not such Submission is selected as a winning Submission. BY SUBMITTING THE ORIGINAL SUBMISSION, THE ENTRANT REPRESENTS AND WARRANTS THAT HE/SHE HAS ALL RIGHT, TITLE, AND INTEREST NECESSARY TO GRANT THE SPONSOR THE WORLDWIDE, IRREVOCABLE AND UNRESTRICTED RIGHT AND LICENSE TO ADAPT, PUBLISH, USE, EDIT AND/OR MODIFY SUCH SUBMISSION IN ANY WAY AND POST THE ORIGINAL SUBMISSION ON THE INTERNET AND USE THE ORIGINAL SUBMISSION IN ANY OTHER WAY AND AGREES TO INDEMNIFY AND HOLD SPONSOR HARMLESS FROM ANY CLAIMS TO THE CONTRARY. IN ADDITION, IF AT ANY TIME DURING THE CONTEST ENTRY PERIOD OR AT ANY TIME THEREAFTER, SPONSOR DETERMINES THAT NOT ENOUGH OR NO ELIGIBLE ENTRIES EXIST FROM WHICH TO DETERMINE THE WINNERS, THEN SPONSOR MAY IN ITS SOLE AND EXCLUSIVE DISCRETION DETERMINE THAT NOT ENOUGH OR NO ELIGIBLE ENTRIES EXIST, AND THEN MAY EITHER SUSPEND OR TERMINATE THE CONTEST OR MODIFY IT (OR ANY PARTS THEREOF) IN ANY EQUITABLE MANNER THAT SPONSOR DEEMS APPROPRIATE IN ITS SOLE AND EXCLUSIVE DISCRETION, INCLUDING, WITHOUT LIMITATION, BY NOT AWARDING ANY ONE OR MORE OF THE PRIZING SET FORTH IN THESE OFFICIAL RULES.

In conjunction with implementation of the Contest, Sponsor may post nominations on the Website and perhaps elsewhere. Such posting is intended for entertainment and informational purposes only. FOR THE AVOIDANCE OF DOUBT, SUCH POSTING DOES NOT CONSTITUTE ANY REPRESENTATION BY SPONSOR OR ADMINISTRATOR AS TO THE ELIGIBLITY OF AN ENTRY/NOMINATION OR NOTIFICATION THAT A NOMINEE HAS BEEN SELECTED AS A FINALIST OR A GRAND PRIZE WINNER IN THE CONTEST.

Selection of Finalists:

Beginning on or about 12/7/2019, a judging panel comprised of representatives of Sponsor and Administrator will review nominations from all eligible Entries and select the top Nominees as Finalists; Finalist Nominees will advance to the second round of judging as discussed below. (Should multiple eligible Entries identify the same Nominee, the content of all such Entries/nominations will be considered as part of the initial judging). Approximately twenty (20) Nominees will be selected as Finalists, but Sponsor/Administrator reserve the right to select fewer than twenty (20) Finalist Nominees due to there being an insufficient number of quality eligible Entries/nominations received or for any other reason.

Finalist Nominees will be selected based on the following criteria:

  • Compelling nature of story (25%)
  • Alignment with the values of the Quick Lane® Tire and Auto Center brand (50%)
  • Suitability for possible use by Sponsor for advertising and publicity purposes (25%)

In the event of a tie, the Nominee among those tied who received the higher/highest score in compelling nature of story, will be deemed the Finalist Nominee.

Finalist Nominees who are not selected in the second round of judging (as discussed below) will not receive any prize or compensation.

Winner Determination:

  • To determine the Grand Prize winners, an additional judge will conduct a second round of judging based on their re-evaluation of the Finalist Nominees according to the criteria used in the initial judging to select the Finalists as discussed above.
  • In the event of a tie, the Finalist Nominee among those tied who received the higher/highest score in compelling nature of story in the initial judging to select the Finalist Nominees, will be deemed a potential Grand Prize winner.

Winner Notification:

  • Administrator will attempt to notify by telephone or email the Entrant who, in his/her Entry, nominated an individual who was selected as a potential Grand Prize winner (If more than one [1] Entrant nominated the same potential winner, only one (1) of the Entrants who nominated such potential winner will be contacted; Administrator will select in its sole discretion the Entrant to be so contacted.)
  • If potential Grand Prize winner is a Veteran who nominated him/herself, Administrator will seek to notify such Veteran even if Entrant[s] also nominated such Veteran.)
  • Each potential Grand Prize winner (including a Nominee who is a Veteran who nominated him/herself) must execute and return a Declaration of Compliance and Liability Release and, unless prohibited by law, a Publicity Release (“Declaration/Release”) to Administrator by email or facsimile within three (3) days from the delivery of Administrator’s email or facsimile to be eligible to claim the prize.
  • The Entrant who nominated a potential Grand Prize winner must provide the potential winner’s signed Release Form as well as completing a Declaration/Release for him/herself, within the indicated three (3) day period; if Grand Prize winner is a Veteran who nominated him/herself, such Veteran must complete and return a Self-Nomination Release Form, within the indicated three (3) day period.
  • If the Entrant who nominated a potential Grand Prize winner (or if potential winner is a Veteran who nominated him/herself, such Veteran) cannot be contacted within the specified time after the first attempt to contact him/her, if he/she fails to provide Release Form and Declaration/Release signed by potential winner and/or to timely execute and return the Declaration/Release on his/her own behalf (for potential winner who is a Veteran who nominated him/herself, if such Veteran fails to timely execute and return the Declaration/Release or Self-Nomination Release Form), the applicable potential winner will forfeit the prize based on such Entrant’s nomination (for potential winner who is a Veteran who nominated him/herself, such Veteran will forfeit the prize).

Three (3) Grand Prizes:

Each Grand Prize is a $10,000 scholarship to a college or university (including both four [4] year and two [2] colleges and universities) located in the 50 United States or Washington, DC which has been accredited by the U.S. Department of Education. Community colleges and junior colleges are specifically included within the definition of college or university. Total value of all Prizes is $30,000.

Prize Restrictions:

  1. Grand Prize-winning Nominee must be enrolled in a qualified college or university on either a part-time or full-time basis.
  2. Scholarship is a grant or payment to be made to support Grand Prize-winning Nominee’s academic tuition fee but does not include non-tuition expenses such as food, room and board and books.
  3. Sponsor will make scholarship payments directly to the college/university where Grand Prize-winning Nominee is enrolled, contingent upon Grand Prize-winning Nominee supplying Sponsor/Administrator with an official statement from the bursar or other applicable office at the college/university. IN NO EVENT WILL THE GRAND PRIZE-WINNING NOMINEE RECEIVE ANY PAYMENTS DIRECTLY FROM SPONSOR OR ADMINISTRATOR.
  4. If Grand Prize-winning Nominee is not enrolled at a qualified college/university by xx/xx/xx, the Grand Prize will be forfeited, and Sponsor will not have any liability or obligation to such Grand Prize-winning Nominee.
  5. Should Grand Prize-winning Nominee cease to be enrolled at a qualified college/university prior to disbursement of the $10,000 scholarship monies for any reason, any remaining monies will revert to Sponsor, with Sponsor having no further liability or obligation to Grand Prize-winning Nominee.
  6. Prize may not be transferred or assigned in whole or in part. Winning Nominee will be responsible for paying all applicable taxes on prize. Sponsor will report winning Nominee’s receipt of prize to governmental authorities as required by applicable law, with issuance of an IRS 1099 Tax Form for the value of prize.

Releases:

  • By participating, Entrants and Nominees (including a Veteran who nominated him/herself) each release Contest Entities, their respective directors, officers, agents and employees, as well as Facebook, Inc./Instagram (collectively the “Released Parties”) from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or (to the extent applicable as per these Official Rules) the acceptance, possession, use, or misuse of the prize.
  • Except where prohibited by law, acceptance of Grand Prize constitutes winning Nominee’s permission for Sponsor and its designees to use winning Nominee’s name, hometown, likeness, statements, other personally identifiable information for Contest, advertising and marketing purposes in any media throughout the world without prize, incentive, consideration, consent or review; and upon request, winning Nominee will provide written consent to such use.

Limitations of Liability:

  • Released Parties are NOT responsible for:
    • Any incorrect or inaccurate information supplied by Entrants (about Nominees or otherwise) or Nominees while participating in the Contest, incorrect or inaccurate transcription of entry information, or for any human or other error, lost data, omission, interruption, deletion, defect, any other error or malfunction, or late, lost, damaged, misdirected Entries/nominations;
    • Technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in cellular networks, phone lines or network hardware or software;
    • Unauthorized human intervention in any part of the entry process;
    • Technical or human error which may occur in the administration of the Contest or the processing of Entries;
    • Late, lost, incomplete, misdirected, corrupted, jumbled, inaccessible, damaged or compromised Entries, regardless of cause (all of which are void); and
    • Any damage to Entrant’s or another’s computer/mobile device (or information stored thereon) due to participation in the Contest.
  • Sponsor’s/Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  • Force Majeure: If, for any reason beyond Sponsor’s control, the Contest (or any part thereof) is not capable of running as originally planned (for example, fire, flood, storm or other natural cataclysm, riot or strike), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and conduct the Contest, making the prizes available in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted on the Contest Website and at events to the extent feasible.
  • Any attempt to tamper with the Contest; to defraud Sponsor or Administrator in conjunction with the operation of the Contest ( as determined by Sponsor/Administrator in their sole discretion) will result in automatic disqualification of Nominee (if applicable), as well as exposing any individual suspected of such conduct (whether or not an Entrant or Nominee) to prosecution and liability to the fullest extent allowed by law.

Governing Law; Dispute Resolution:

  • These Official Rules and the Contest shall be governed by the law of Michigan (except for the conflict of law/choice of law rules of Michigan or of any other jurisdiction which would lead to the application of the law of any jurisdiction other than Michigan.)
  • To the fullest extent permitted by law, Entrants and Nominees agree that: (i) any claim, dispute or cause of action regarding the Contest or these Official Rules shall be brought individually (NOT AS PART OF A CLASS ACTION) in the federal or state courts of Michigan; (ii) they consent to the personal jurisdiction of such courts as the exclusive tribunal for adjudication of any such claim/dispute/cause of action; (iii) their recovery will be limited to actual out-of-pocket costs involved in participating in the Contest (if any) and they expressly waive their right to all other forms of recovery, including by way of example only, punitive, consequential, indirect, incidental, special and exemplary damages as well as attorneys’ fees for bringing such claim/dispute/cause of action. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
